Welcome to the "BitBox" cloud platform, where you can share and store your files safely and with confidence. By accepting these Terms, you agree to use our platform in accordance with the terms and conditions set out below. Please read them carefully before using the platform.
Contracting Entity
The "BitBox" platform is operated and provided by BitBox (under an operating authorization from KM Holding on behalf of شركة آيات الوقفية), headquartered in the Kingdom of Saudi Arabia.
By accepting these Terms, you enter into a binding agreement with this entity.
Definitions
Site or Platform: refers to the "BitBox" platform and all of its services and features.
User: refers to any person or entity that uses the platform.
Content: refers to any information or data uploaded, stored, or shared through the platform, including content in the user's profile or posts, which you may choose to enter manually or sync from a third-party site where available. "BitBox" does not verify the accuracy or completeness of user content, and it may be subject to errors.
Eligibility and Your Account
You must be 13 years of age or older to use this Site.
You represent that you are of legal age to enter into a binding contract, or that you have the necessary authority of the legal entity to do so, and that all registration information you provide is accurate and truthful and that you will keep it accurate.
You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your account. Your account is personal and may not be shared for any reason.
You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security.
You are responsible for all charges resulting from the use of your account through the Service, including charges resulting from unauthorized use, until you notify us thereof immediately.
Content and Acceptable Use
You agree to use the Service for lawful purposes only, and that you are solely responsible for your use of it, your communications, and the content you publish through it.
It is prohibited to post or transmit any material that is unlawful, infringing, threatening, harassing, defamatory, vulgar, obscene, pornographic, abusive, hateful, or otherwise objectionable in any way, including any material that encourages criminal conduct, infringes the intellectual property rights of others, impersonates any individual or entity, or violates any applicable law.
The Service may not be used in any manner that interferes with its normal operation or with another user's use of it, including: attempting to gain unauthorized access to non-public areas of the Service or our systems; probing or testing for security vulnerabilities; accessing it by any means other than the published interfaces; forging any source information or packet header; transmitting viruses or unsolicited messages or flooding the Service; or using its content to create a similar or competing service.
You are solely responsible for your content and all risks associated with it, including any reliance on it by others or any disclosure that identifies you or a third party, and you represent and warrant that it does not violate any of these Terms. You may not imply that your content is provided or endorsed by us.
"BitBox" is not obligated to back up any content, and content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backups.
We reserve the right to review content published on the platform in the event of an infringement of proprietary rights, upon receipt of a valid complaint, or at our sole discretion, and we may choose to remove any content that we consider to be in violation of these Terms or applicable laws, without any obligation on our part to conduct a prior or regular review of every piece of content uploaded. You agree that "BitBox" is not liable for any loss you incur as a result of our removal of, or refusal to publish, content.
We reserve the right, without obligation, to review any content, investigate, and take appropriate action at our discretion if you violate these Terms, including removing or modifying the content and terminating your account.
"BitBox" is not responsible for any third-party communications you receive regarding your account; you are solely responsible for assessing the identity and reliability of any correspondence you receive.
Intellectual Property
All content you create or publish on the Site remains your property, and the Site grants you a non-exclusive license to use the available tools and services.
All intellectual property rights relating to the Site and the services provided through it remain our property, and no part of them may be used without prior written permission.
You confirm that you own all rights to any content you upload, import, or copy, or that you have the necessary licenses and consents to lawfully access, use, and publish it, including any designs, images, animations, videos, audio files, fonts, logos, code, or written works.
You confirm that you have obtained all consents required under applicable laws with respect to publishing any personal information or images belonging to any individual or entity within the content you upload.
To the extent required by data protection laws, you undertake to publish and maintain a privacy notice that meets the requirements of those laws on any digital properties from which you collect data, and you bear full responsibility for the lawfulness of your collection of your contacts' data, including obtaining the consents necessary to enable "BitBox" to lawfully use cookies and similar tracking technologies.
You confirm that your content does not infringe any copyright, trademark, privacy, or other proprietary rights of any third party.
Prior or future third-party licenses may conflict with your use of the materials in a trademark or corporate identity, and may adversely affect your ability to secure international protection for a trademark that incorporates these materials. "BitBox" makes no representations regarding the availability of such protection.
Fees, Billing, and Subscriptions
The Site grants you a free subscription to the basic plan.
You may upgrade to paid plans to obtain more storage space and additional benefits.
The payment total and the electronic invoice will indicate whether prices are inclusive of value-added tax (VAT) or whether VAT is added at checkout, according to the configuration in effect at the time of purchase.
We reserve the right to change prices at any time, and you will be notified of any change before it takes effect.
We accept payment via mada, Visa, and Mastercard, and all transactions are processed through a secure, licensed payment gateway.
An electronic invoice will be sent to you after every purchase.
Your paid subscription renews automatically at the end of each billing cycle, according to the plan you have chosen, unless you cancel it before the renewal date. You can cancel your subscription at any time from the billing page within your account, and you will retain access to your plan's benefits until the end of the current paid period, with no further charges thereafter.

APIs and Third-Party Services
We may offer services through, or fundamentally reliant on, third-party application programming interfaces (APIs). By using them, you agree to comply with the terms of service of those third parties, and "BitBox" does not guarantee, and bears no responsibility for, their functionality or security.
"BitBox" is not a party to any transaction between you and any service provider through the Service, and any dispute shall be resolved directly between you and that provider.
We may use your name and/or logo to identify you as a customer of the platform, without this creating any ownership right therein.
Disclaimer of Warranties
The Site is provided "as is" without warranties of any kind, and we are not liable for any indirect, incidental, special, or consequential damages arising from your use of it. We do not guarantee that the Site will be error-free or available at all times.
You are responsible for any text content or images you upload, and for the materials resulting from them.
You agree not to include any sensitive personal data (racial or ethnic origin, political opinions, religious or philosophical beliefs, health data) in any input to "BitBox".
"BitBox" makes no warranties regarding the suitability or availability of any material, content, product, or service accessed through the Service, and does not examine the validity or quality of any provider thereof.
Neither "BitBox" nor its employees make any representations with respect to any content published on the Site by any party.
Any information on the Service, including any page on the social media platforms associated with it, is for informational purposes only. You assume all risks when using the Service and interacting with other users through it.
Limitation of Liability
In all cases, our total liability to you shall not exceed the amount you have actually paid us for use of the services.
This limitation does not apply to any damage resulting from gross negligence or willful misconduct on our part, or in any case where liability may not be excluded or limited under the laws in force in the Kingdom of Saudi Arabia.
Basic Plan vs. Business Plans
The Service is offered in one of two ways:
Free Plan: includes individual and educational plans, and may be used for personal or non-profit purposes only; it does not cover commercial use.
Business and Project Plans: allow the services to be used for both personal and commercial purposes, with multiple options.
Feedback and Suggestions
By submitting any ideas, suggestions, or documents to us, you agree that: (a) your feedback does not contain confidential information belonging to third parties; (b) we are under no obligation of confidentiality with respect to it; (c) we may already have something similar under development; and (d) you grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use, modify, and publish it, and you waive any moral rights contained therein.
Account Termination and Service Discontinuation
The Site reserves the right to suspend or terminate your account at any time without prior notice if you violate these Terms.
You may terminate your account at any time by contacting us.
The Service may be modified, updated, suspended, or discontinued at any time without notice or liability; in the event the Service is discontinued, data will be deleted in accordance with the approved service discontinuation procedures.
Changes to These Terms
The Site reserves the right to amend these Terms at any time. You will be notified of any material changes via email or Site notifications, and your continued use of the Site after the amendment constitutes your acceptance of the amended Terms.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, and any dispute arising from them shall be resolved before the competent courts in the Kingdom of Saudi Arabia.
